In response to the growing recognition of informal logic as a discipline in its own right, this collection of essays from leading contributors in the field provides the formative knowledge and historical context required to understand the development of a so far little studied subject area.

Steadily on the increase in political argumentation since then, the argumentum ad hominem has been carefully refined as an instrument of (...) "oppo tactics" and "going negative" by the public relations experts who now craft political campaigns at the national level. It has been so prominently used in the major political campaigns, debates, and advertisements of the past few years that there has even been a reaction against it--a feeling that we have gone too far in this direction and that some kind of restraint is needed. 1 But there has been no evidence of such restraint in the argumentation used in recent campaigns. Perhaps what might be helpful is a better understanding on the part of voters and campaigners of how to evaluate ad hominem arguments critically.How does the ad hominem argument really work as a way of molding public opinion, why is it so often so effective, and how can it be defended against? How can it be evaluated as a clearly identifiable type of argument, by some kind of objective standards, in a way that can be applied to particular cases? These appear to be tough questions, but recent research has made some not inconsiderable progress toward answering them.The purpose of this article is to present a new case study of a type of argument commonly used in political discourse, a case study that makes use of the dialectical normative framework for identifying and evaluating personal attack (ad hominem) arguments that is developed in a series of works by Henry W. Johnstone Jr. (1952); Alan Brinton (1985, 1995); Frans H. van Eemeren and Rob Grootendorst (1984, 1995); Erik C. W. Krabbe and Douglas N. Walton (1993), Walton (1989, chap. 6; 1998); and van Eemeren, Grootendorst, Francisca Snoeck Henkemans et al. (1996). This particular case, although typical of so many ad hominem arguments currently [End Page 101] in use in political discourse, has some special features that turn out to be quite interesting not only in showing how the dialectical framework applies to cases, but also in advancing our knowledge of how the ad hominem type of argument works in political argumentation in a democratic system for which the media reportage of events is a big factor in influencing voting. 1. Framework for analysis and evaluation Although the argumentum ad hominem, or personal attack argument, has been traditionally treated as a fallacy in logic, recent research in argumentation (as cited above) shows that, in many cases,--including cases in political argumentation--ad hominem arguments, as used in conversational arguments, are not fallacious. Research has shown that, while some personal attack arguments can definitely be judged fallacious, many others are quite reasonable (when evaluated in the appropriate context), while still others should be evaluated as weak (insufficiently supported) but not fallacious. As shown in this case study, the real function of an ad hominem argument (when properly used) is to attack an arguer's credibility in order to criticize the argument she advocates.Before going any further, it is necessary to define some terminology brought to use in the research cited above. An ad hominem argument is the use of personal attack in a dialogue exchange between two parties, where the one party attacks the character of the other party as bad, in some respect, and then uses this attack as a basis for criticizing the other party's argument. An argument is fallacious if it is a special baptizable (Johnson 1987) type of argument that is used by one party in a dialogue exchange in such a way that it blocks or interferes with the collaborative realization of the goal of the type of dialogue in which the two participants are supposed to be engaged (Walton 1995). Hull et al. make a direct connection between selection and replication. My view is that selection, at its causal crux, is not inherently connected to replication. I make plain the causal crux of selection, distinguishing it from replication. I discuss implications of my results for Hull et al.'s critique of Darden and Cain (1989).

V. Alan White and Gertrud Walton have published responses to my note on Einstein's simultaneity Gedankenexperiment, in which I present a version of the argument free of the flaws to be found in that given by Einstein. White thinks I go too far, that no reformulation is necessary; Walton, that I don't go far enough, and that i the inconsistencies in Einstein's exposition are ‘irreconcilable’. I r shall try to explain why I think both are mistaken.

Two brainless curs, Alan Brinton and Douglas Walton, have recently had the impudence to suggest that several of my views on argumentum ad baculum are mistaken. While hardship and toil await them in this life and eternal damnation in the next, punishment begins with this paper. In it, I clarify my position, defend my views, and critique their arguments. Last, I argue ad baculum against both of them, threatening both with the loss of reputation, employment, and respect unless (...) they repudiate every objection raised against me and publicly abase themselves. Authors frequently refer to gene-based selection in biological evolution, the reaction of the immune system to antigens, and operant learning as exemplifying selection processes in the same sense of this term. However, as obvious as this claim may seem on the surface, setting out an account of “selection” that is general enough to incorporate all three of these processes without becoming so general as to be vacuous is far from easy. In this target article, we set out such a general (...) account of selection to see how well it accommodates these very different sorts of selection. The three fundamental elements of this account are replication, variation, and environmental interaction. For selection to occur, these three processes must be related in a very specific way. In particular, replication must alternate with environmental interaction so that any changes that occur in replication are passed on differentially because of environmental interaction. One of the main differences among the three sorts of selection that we investigate concerns the role of organisms. In traditional biological evolution, organisms play a central role with respect to environmental interaction. Although environmental interaction can occur at other levels of the organizational hierarchy, organisms are the primary focus of environmental interaction. In the functioning of the immune system, organisms function as containers. The interactions that result in selection of antibodies during a lifetime are between entities (antibodies and antigens) contained within the organism. Resulting changes in the immune system of one organism are not passed on to later organisms. Nor are changes in operant behavior resulting from behavioral selection passed on to later organisms. But operant behavior is not contained in the organism because most of the interactions that lead to differential replication include parts of the world outside the organism. Changes in the organism's nervous system are the effects of those interactions. The role of genes also varies in these three systems. Biological evolution is gene-based (i.e., genes are the primary replicators). Genes play very different roles in operant behavior and the immune system. However, in all three systems, iteration is central. All three selection processes are also incredibly wasteful and inefficient. They can generate complexity and novelty primarily because they are so wasteful and inefficient. The image of God in the Bible is a projection of the normal human, raised to the highest degree. This excludes the human body which is different. Knowledge itself is based in bodily experience, and a starting place for a theology of disability may be found in the phenomenology of different bodies. When philosophers and theologians use the image of the face of God, this hegemony of the average is particularly noticeable. Blind people are only one of a number of (...) human experiences without the face, and if the theological tradition is to be redeemed from the dominance of exclusion, the image of God must be poly-anthropomorphic rather than uniform. This paper explains the importance of classifying argumentation schemes, and outlines how schemes are being used in current research in artificial intelligence and computational linguistics on argument mining. It provides a survey of the literature on scheme classification. What are so far generally taken to represent a set of the most widely useful defeasible argumentation schemes are surveyed and explained systematically, including some that are difficult to classify. A new classification system covering these centrally important schemes is built.

The integration of technology in care is core business in nursing and this role requires that we must understand and use technology informed by evidence that goes much deeper and broader than actions and behaviours. We need to delve more deeply into its complexity because there is nothing minor or insignificant about technology as a major influence in healthcare outcomes and experiences. Evidence is needed that addresses technology and nursing from perspectives that examine the effects of technology, especially related to (...) increasing demands for efficiency, the relationship of technology to nursing and caring, and a range of philosophical questions associated with empowering people in their healthcare choices. Specifically, there is a need to confront in practice the ways technique influences care. Technique is the creation of a kind of thinking that is necessary for contemporary healthcare technology to develop and be applied in an efficient and rational manner. Technique is not an entity or specific thing, but rather a way of thinking that seeks to shape and organize nursing activity, and manage efficiently individual difference(s) in care. It emphasizes predetermined causal relationships, conformity, and sameness of product, process, and thought. In response is needed a radical vision of nursing that attempts in a real sense to ensure we meet the needs of individuals and their community. Activism and advocacy are needed, and a willingness to create a certain detachment from the imperatives that technique demands. It is argued that our responsibility as nurses is to respond in practice to the errors, advantages, difficulties, and temptations of technology for the benefit of those who most need our assistance and care. The notions of burden of proof and presumption are central to law, but as noted in McCormick on Evidence, they are also the slipperiest of any of the family of legal terms employed in legal reasoning. However, recent studies of burden of proof and presumption (Prakken et al. 2005; Prakken and Sartor 2006). Gordon et al. (2007) offer formal models that can render them into precise tools useful for legal reasoning. In this paper, the various theories and formal models are (...) comparatively evaluated with the aim of working out a more comprehensive theory that can integrate the components of the argumentation structure on which they are based. It is shown that the notion of presumption has both a logical component and a dialectical component, and the new theory of presumption developed in the paper, called the dialogical theory, combines these two components. Liberalism has been one of the leading incarnations of political thought for the past two centuries and it was also the first form of political theory to acquire a truly global reach. Although best known for the hugely influential Anarchy, State and Utopia, Robert Nozick eschewed the label 'political philosopher' because the vast majority of his writings and attention have focused on other areas. Indeed the breadth of Nozick's work is perhaps greater than that of any other contemporary philosopher. Une des réactions qui m’a le plus surpris suite à la publication, avec Alan Sokal, d’ Impostures intellectuelles (1), c’est l’accusation qui nous a été faite d’être « positivistes ». En effet, nulle part nous ne défendons cette doctrine et, les rares fois où nous en parlons, c’est pour la critiquer. Néanmoins j’ai vite compris qu’il fallait distinguer entre positivisme et « positivisme », c’est-à-dire entre une doctrine philosophique complexe ayant prospéré à une certaine époque et à laquelle plus (...) personne n’adhère, du moins dans son intégralité, et une épithète qui est utilisée pour discréditer l’adversaire (2). Dans cet article, je voudrais brièvement expliquer certains aspects du positivisme tel qu’il a réellement existé, les difficultés que cette doctrine a rencontrées et l’héritage de cette tradition qui me semble défendable (et qui est en général facilement discrédité grâce à l’utilisation du label « positiviste »). Je me limiterai au positivisme « anglo-saxon », c’est-à-dire au Cercle de Vienne et à ses successeurs, qui est à la fois plus récent et plus influent, à l’échelle mondiale, que celui de Comte. De plus, j’isolerai de cet ensemble complexe de doctrines certains aspects.. (shrink)

From a national U.S. sample of senior academic biochemists, ninety-four indicated that they personally knew of an incident of scientific wrongdoing. Among these individuals, less formal actions against an offending individual were endorsed when either actions were believed to have the potential to publicly embarrass the offending individual, or the actions might adversely affect the professional career of the whistleblower. These relationships remain significant after controlling for professional status, career age, and current level of formal departmental administrative responsibility.
